Key takeaways
- Is cold calling illegal? No. B2B cold calling is legal in India, the UK, the US and the UAE, but each market limits who you may call, from which line and with what technology.
- India is the sharpest edge. Under TRAI’s 2025 and 2026 amendments, complaints from five unique recipients in ten days (three, if the operator’s AI also flags the number) against an unregistered sender can get all its outgoing lines barred for 15 days, and repeat offenders are disconnected for a year.
- In the UK, screen against TPS and CTPS and treat sole traders like consumers. In the US, ordinary B2B calls mostly sit outside Do Not Call, but autodialers and recorded voice to mobile numbers do not.
Is cold calling illegal? Short answer: no, but it is one of the most rule-bound ways to reach a buyer, and the rules change at every border. Here is what B2B sellers need to know about TRAI in India, TPS and CTPS in the UK, the TCPA and Do Not Call rules in the US, and what we could and could not verify for the UAE.
Is cold calling illegal, and is B2B cold calling legal?
No. Cold calling is legal in India, the UK, the US and the UAE. The law controls how you do it: which numbers you may dial, from which line, with what technology, and what you must do when someone says stop. B2B calls get lighter treatment in some countries, but nowhere are they free of rules.
Four questions decide almost every case. Is the number on a do-not-call register? Is the person a company or an individual, including a sole trader? Is the call dialled by a human or by an auto-dialer or recorded voice? Are you calling from a registered, identifiable line? The answers differ by country, so a script that is fine in Pune can break rules in Leeds. This guide is general information, not legal advice; check with counsel for your market. For how to run calls well once they are legal, see our B2B cold calling guide.
What do TRAI’s telemarketing rules and DND mean for cold calling in India?
India is the strictest of the four. TRAI’s Second Amendment to the TCCCPR, notified on 12 February 2025 and tightened again by a Third Amendment on 18 September 2026, says commercial calls must come from a registered sender using registered headers or number series meant for the purpose. Complaints from five unique recipients within ten days can get an unregistered sender’s outgoing lines barred.
The details, from the regulation text: once five or more unique recipients complain within ten days, the access provider suspends the sender’s outgoing services and investigates. On a first violation, outgoing services on all the sender’s telecom resources, including PRI and SIP trunks, are barred for 15 days. A second violation means disconnection for one year, blacklisting and blocked devices. The old trigger was ten complaints in seven days. Recipients no longer need to be registered on DND to complain about an unregistered telemarketer. Promotional auto-dialer or robo calls may run only on the 140-series; service and transactional robocalls go on the 1600-series, and auto-dialer use must be declared to the access provider. Do DND rules cover business calls? We found no business-to-business exemption in the amendment, so do not assume a company number is fair game. Read literally, a sales call from an ordinary number is commercial communication from an unregistered sender, and the exposure is five complaints in ten days, not a lawsuit. Names and numbers are also personal data under the DPDP Act 2023, whose Rules (notified November 2025) are phasing in over the coming months.
The Third Amendment, explained in TRAI’s September 2026 press release, goes further. Action can now start after just three unique complaints in ten days if the operator’s AI system has also flagged the caller’s number as a likely spammer, and if five or more of a sender’s numbers are flagged within ten days the operator can re-verify KYC, bar outgoing calls or disconnect. Any automated calling (autodialers, robocalls, pre-recorded voice) must be declared to your telecom provider in advance, or it is treated as spam. Calls to someone who enquired about your product are allowed only for seven days after the enquiry, and that enquiry must be in writing or digital and kept on record.
How do TPS and CTPS work for B2B cold calling in the UK?
In the UK, live B2B calls fall under PECR. You may call a company without consent unless its number is on the Corporate Telephone Preference Service (CTPS) or it has told you to stop. You must screen against both TPS and CTPS, say who you are and show a callable number. Sole traders and some partnerships count as individuals.
The ICO’s business-to-business marketing guidance says you must screen against both registers and your own do-not-call list, that corporate subscribers (companies, LLPs, Scottish partnerships) can be called if unregistered, and that sole traders and other partnerships get the protections of individuals. A registration takes up to 28 days to become active, so a list screened months ago is a risk, and a bought list needs a recent screen. Automated calls need prior consent. UK GDPR still applies to the personal data on your list, including telling people where you got their details. Action runs from enforcement notices to monetary penalties; check the ICO for current figures.
Does the TCPA cover B2B cold calling in the US?
Mostly not for ordinary one-to-one B2B calls, but yes for autodialers and recorded voice. The FTC says most calls between a telemarketer and a business are exempt from the Telemarketing Sales Rule, and the National Do Not Call Registry covers personal numbers only. The TCPA still limits autodialed and prerecorded calls to mobile numbers without consent.
The exceptions matter. Under the FTC’s Telemarketing Sales Rule guidance, calls to induce the retail sale of nondurable office or cleaning supplies, such as paper or toner, are not exempt. The FCC rule at 47 CFR 64.1200 bars autodialed or artificial and prerecorded voice calls to wireless numbers without prior express consent, and it is written around the line, not around whether the person is a consumer or a purchasing manager. TCPA claims carry statutory damages of $500 per call, up to $1,500 if willful, which is why plaintiffs’ lawyers watch dialler-heavy campaigns. The FTC lists civil penalties above $50,000 per violation, adjusted yearly. The FCC’s 8 a.m. to 9 p.m. window is written for residential subscribers but is a sensible limit anywhere. Many states add telemarketing laws of their own, some stricter than the federal ones.
What are the cold calling rules in the UAE?
We could not verify current UAE telemarketing details on official pages, so we state only what is solid. TDRA is the telecom regulator and runs a spam-complaint service. The PDPL (Federal Decree-Law 45/2021) governs personal data. Check TDRA and your carrier for current rules on calling hours and any do-not-call register.
A prudent default for UAE campaigns is to behave as you would in the UK. Dial business numbers taken from reliable listings, identify yourself at once, offer an opt-out on the call, keep a suppression list and avoid automated or recorded calls. Record where each number came from, because names and direct numbers can be personal data under the PDPL. Rules in this area move, so have a UAE adviser confirm the position before a large sprint. Cold email carries its own rules in the Gulf; our cold email outreach guide covers them.
How do the four countries compare for B2B cold calling?
India is the only one of these four where a complaint count can switch off your phone lines. The UK turns on registers and on who the person is. The US turns on the dialling technology and the line type. The UAE needs a local check. The table sets the main rule, the B2B note and the penalty risk side by side.
| Country | Main rule | B2B note | Penalty risk |
|---|---|---|---|
| India | TRAI TCCCPR, amended February 2025 and September 2026: commercial calls from registered senders; autodialer calls declared in advance; promotional calls on the 140-series | No B2B exemption found in the amendment; anyone can complain about an unregistered telemarketer | Five complaints in ten days, or three plus an AI spam flag: lines barred 15 days; repeat: disconnected one year and blacklisted |
| UK | PECR plus TPS and CTPS screening; identify yourself and show your number | Companies can be called unless on CTPS; sole traders and some partnerships are treated as individuals | ICO enforcement notices and monetary penalties |
| US | TCPA (autodialers, prerecorded voice) and the FTC Telemarketing Sales Rule | Most B2B calls exempt from the TSR (nondurable office supplies excepted); Do Not Call covers personal numbers only | TCPA damages of $500 per call, up to $1,500 if willful; FTC penalties above $50,000 per violation |
| UAE | TDRA oversees telecom and spam complaints; PDPL covers personal data | Current calling-hour and register details not verified here; check TDRA and your carrier | Regulator complaints and data-protection exposure; confirm locally |
What habits keep B2B cold calling compliant?
Five habits cover most of the risk in any country: human-paced one-to-one calls, screened lists, a callable and identified line, opt-outs honoured the same day, and records of where every number came from. None of this slows a good sales team much, and it keeps complaints rare and survivable.
Put them into the process rather than into a policy document nobody reads:
- Dial by hand, or with click-to-call that never connects before a human is ready. Skip auto-dialers and recorded voice unless you hold consent.
- Screen every list against your own do-not-call list and, for UK numbers, TPS and CTPS within the last 28 days.
- In India, run promotional calls on the 140-series through your telecom provider, and never use a transactional or service series for sales calls.
- Say who you are and why you are calling in the first sentence, and show a number people can call back.
- Log every ‘do not call again’ the same day, across phone, email and LinkedIn.
- Call after a signal where you can: a reply, a website visit or a trade-fair meeting gives you a reason to call and a clear answer if anyone asks why.
A cold call is legal. A cold call from an unregistered line, to a number on a register, through an auto-dialer is where the trouble starts. Fix the list and the line before you fix the script.— Murtaza Udaypurwala, DESENO
The bottom line
Cold calling is not illegal, but it is the most heavily policed of the cold channels. In India, the 140-series and the five-complaints trigger are what matter. In the UK, screen TPS and CTPS and watch sole traders. In the US, keep dialers and recorded voice away from mobile numbers without consent. In the UAE, verify locally. Laws change, so re-check each year. Use calls to follow up warm leads and signals, and build the rest of your pipeline through email, LinkedIn and your site; our guide to B2B lead generation in India shows how the channels fit together. Frequently asked questions
Is cold calling illegal?
No. Cold calling is legal in India, the UK, the US and the UAE, but each country restricts who you may call, from which line and with what technology. Registers such as DND, TPS and CTPS, rules on auto-dialers and recorded voice, and identification duties all apply. This is general information, not legal advice, so check with counsel for your market.
What are the cold calling rules in India?
Under TRAI’s TCCCPR amendments of February 2025 and September 2026, commercial calls must come from a registered sender, autodialer calls must be declared in advance, and promotional calls belong on the 140-series. If five unique recipients complain within ten days, or three when the operator’s AI also flags the number, an unregistered sender’s outgoing lines can be suspended. A first violation means a 15-day bar; repeats mean one-year disconnection.
Do DND rules apply to business calls in India?
We found no business-to-business exemption in TRAI’s 2025 and 2026 amendments, so assume a sales call to a company number is still commercial communication. The rules also let recipients complain about an unregistered telemarketer even if they never registered on DND. Run promotional calls through a registered arrangement on the 140-series and confirm details with your telecom provider.
Do TPS and CTPS apply to B2B cold calls in the UK?
Yes. Check numbers against both TPS and CTPS and your own do-not-call list before calling. Companies, LLPs and Scottish partnerships can be called if they are not registered, but sole traders and some partnerships are treated like individuals. Registrations take up to 28 days to take effect, so screen lists recently, say who you are and show your number.
Does the TCPA apply to B2B cold calling in the US?
Partly. The FTC says most business-to-business calls are exempt from the Telemarketing Sales Rule, and the National Do Not Call Registry covers personal numbers only. But the TCPA restricts autodialed and prerecorded or artificial-voice calls to mobile numbers without prior express consent, whoever the recipient is. Many states add their own rules, so check state law too.
Is cold calling allowed in the UAE?
Cold calling is not banned outright, but we could not verify current calling-hour or do-not-call details on official pages, so treat it carefully. TDRA regulates telecoms and handles spam complaints, and the PDPL (Federal Decree-Law 45/2021) covers personal data. Identify yourself, honour opt-outs, avoid automated calls and have a UAE adviser confirm the current rules.
